التزام المتدخل بالضمان لحماية الطرف الضعيف

الملخص
ألقى المشرع على عاتق المتدخل بموجب قانون رقم 09-03 المتعلق بحماية المستهلك وقمع الغش الالتزام بضمان عيوب المنتوجات سواء كانت سلع أو خدمات، كما ألزم المشرع المتدخل بضمان الخدمة ما بعد البيع، فكرس حماية للمستهلك بالسماح له بالعودة بالضمان على المتدخل من أي عيب قد يعتري المنتوج دون حصره لنوع العيب الموجب للضمان كما فعل في القانون المدني، ونتيجة لحق المستهلك في امتلاكه لمنتوج مطابق لرغباته المشروعة فيتقرر له الحق بموجب قانون رقم 09-03 في مطالبة المتدخل بتنفيذ التزامه بالضمان سواء بطريقة ودية ، أو باللجوء إلى القضاء عند تعنت المتدخل عن تنفيذ التزامه وديا . Summary: The current world has undergone a technological development that has led to development in various fields especially economic, the latter led to the contractual imbalance between the professional and the consumer which represents a weak part of the contract due to the absence of a sufficient knowledge of the acquired product. Therefore, if a product with defects humiliating the consumer has only to communicate the speaker in accordance with the rules of civil law, but the latter did not provide adequate protection, therefore the legislator has rushed to guarantee the 'legal obligation of product defect in the consumer contract.
