خيار الوساطة الجنائية في حماية الطفل الجانح على ضوء قانون حماية الطفل 15-12.

الملخص
ملخص: لتجسيد حماية فعالة للطفل الجانح، وحفاظا من المشرع الجزائري على نهجه في الحيلولة دون توقيع العقوبة عليه، وبعيدا عن الأليات التقليدية التي لا تعطي وزنا كافيا للظروف الشخصية والموضوعية للطفل الجانح، وتقوم على ركيزتي العقاب والتجريم، استحدث المشرّع ألية الوساطة بموجب قانون حماية الطفل 15-12. تتناسب هذه الآلية مع تطور العدالة الجنائية، وقوامها تدخل طرف ثالث توكل له مهمة القيام بدور الوسيط بين الطفل الجانح والضحية، على هذ الأساس ظهر ما يسمى بالعدالة التأهيلية التصالحية، والتي تسعى لإيجاد سبل لتقويم سلوك الطفل الجانح قصد إعادة تهيئته وإدماجه اجتماعيا، وإنصاف الضحية وجبر الضرر الذي لحقه من الاضطراب الذي أحدثته الجريمة، بغرض الوصول إلى إنهاء النزاع بين الطرفين بطريقة ودية تفاوضية، بين الطفل الجانح والضحية، وقبل تحريك الدعوى العمومية. Abstract In order to achieve protection for a child who commits a misdemeanor, and in order for the Algerian legislator to maintain his approach in preventing the imposition of punishment on him, apart from traditional mechanisms that do not give sufficient weight to the personal and objective circumstances of the delinquent child, and based on tow pillars are punishment and criminalizationthe legislator introduced the mediation mechanism under the Child Protection Act 15.12 This mechanism is commensurate with the development of criminal justice, the basis of which is the intervention of a third party entrusted with the role of mediator between the delinquent child and the victim, on this basis,emerged so-called restorative and habilitational justice, which seeks to find ways inproving the behavior of the delinquent child in order to reformulate his behavior and facilate social integration of him, and to redress the victim and redress the damage caused by the crime. with a view to reaching an end to the dispute between the parties in a friendly and negotiated manner between the delinquent child and the victim, and before initiating the proceedings in judiciary.
