التقعيد الفقهي من خلال كتاب شرح التلقين للمازري The Jurisprudential Regulation Throughout Theinterpretation Of At-talqin Of Al-maziri

الملخص

معلوم أن القواعد الفقهية مهمة جدا، ولا يستغني عنها الفقيه، فَبِها يضبط الفروع الفقهية الكثيرة والمتشعبة التي يحتاجها الناس في حياتهم، ومن هنا لجأ العلماء إلى جمع تلك القواعد الكثيرة في مصنفات خاصة، لتقريبها للباحثين حتى يستفيدوا منها. وقد ذكر الفقهاء في المبسوطات من كتب الفقه المختلفة كمًّا هائلا من تلك القواعد. ومن بين تلك الكتب المهمة: شرح المازري على كتاب التلقين للقاضي عبد الوهاب، الذي هو مختصر في الفقه على مذهب الإمام مالك رحمه الله. فاخترت منه بعض القواعد الفقهية، وتناولتها بالدراسة شرحا وتأصيلا وتطبيقا، سيرا على منهج بعض الباحثين في استخراج القواعد الفقهية من مبسوطات الفقه. وأرجو أن يكون عملا علميا نافعا، والله ولي التوفيق. It is known that the jurisprudential rules are essential and indispensable for the jurisprudent (Faqih). Due to them, the several and divided jurisprudential branches which are needed in people's life ; are being regulated. Thus, Scholars attended to collect those many rules in special workbooks to bring the researchers closer to its benefits. Also the jurisprudents have mentioned in their expanded books (Mabsotat) a considered number of rules. Among those books : the interpretation of Al-Maziri on the book of At-talqin of the El-Qadi Abd El-wahab, which is a summary inFiqh following the Malikite rite. Therefore, I have chosen some jurisprudential rules and studied them by explaining, rooting and applying following the method of certain researchers in drawing out the rules from ( Mabsutat). Hoping to make it a beneficial research. Allah is the arbiter of success.
