الملخص
ملخص: تظهر أهمية الحوار وفوائده المختلفة كونه أهم أسلوب ظهر في القرآن الكريم وخاصة أنه بني كثير من قصص القرآن على ذلك، وعليه فإننا نقف على إشكالية تتعلق بالخلافيات الدينية والفقهية وأثر الحوار فيها وماهي الضوابط والمناهج التي بها يؤتي ثماره وفوائده؟ وتهدف هذه الدراسة إلى توجيه الضوء حول ضوابط ومناهج الحوار الخلافي الفقهي والمذهبي والتحذير من بقاء أسباب ذلك الخلاف المنبوذ قديما و الحث على جعل الحوار وسيلة في دفع ومعالجة هذه الخلافيات القديمة والمعاصرة للوصول إلى نتائج أفضل في التواصل والتكامل والتعايش الإنساني والاجتماعي، وتظهر أهمية البحث في أهمية الحوار نفسه في الشريعة الإسلامية لنجده طريقا للتواصل والتفاهم وتبادل الأفكار والسماع من الآخر وعدم نبذه وتغريبه، وبالتالي قد يكون سببا في التواصل بدل التنافر؛ و جاء منهج الدراسة وصفيا تحليليا وذلك بالوقوف على بعض النماذج من المناظرات والحوارات الفقهية لنحاول أن نستخلص منها جملة من الضوابط من أجل توظيفها في إعادة فوائد الحوار الفقهي والتقليل من آثار الخلاف في الأمور الدينية والفقهية خاصة. الكلمات المفتاحية: حوار؛ خلاف؛ جدل؛ ضوابط؛ منهج حوار؛حوار فقهي. Abstract: The importance of dialogue and its various benefits appear as the most important method that appeared in the Holy Qur’an, especially since many of the Qur’an’s stories were built on it. Therefore, we stand on a problem related to religious and jurisprudential differences and the impact of dialogue on them, and what are the controls and methods by which it yields its fruits and benefits? This study aims to direct light on the controls and methods of jurisprudential and doctrinal contentious dialogue, and to warn against the persistence of the causes of that rejected dispute in the past, and to urge to make dialogue a means in advancing and addressing these ancient and contemporary disputes. Ideas and hearing from the other and not rejecting or alienating him, and thus may be a reason for communication rather than dissonance; The approach of the study was descriptive and analytical by examining some examples of jurisprudential debates and dialogues in order to try to extract from them a number of controls.
