الملخص

ملخص: نظام المثول الفوري هو آلية قانونية جديدة أدخلها المشرع الجزائري لتسريع الإجراءات الجزائية في القضايا التي لا تتطلب تحقيقاً معمقاً. تم اعتماد هذا النظام بموجب الأمر رقم 15-02 المعدل والمتمم لقانون الإجراءات الجزائية، وذلك على غرار التشريعات المعمول بها في دول أخرى. يسمح المثول الفوري بمعالجة القضايا بصورة سريعة من قبل الجهات القضائية المختصة. و يساعد هذا النظام في تفادي مشكلة تكدس القضايا التي تؤثر سلباً على كفاءة النظام القضائي.كما يشترط النظام احترام الحقوق والحريات المكفولة بموجب النصوص القانونية الوطنية والدولية، لضمان محاكمة عادلة ونزيهة و يوفر النظام آلية سريعة لمعالجة القضايا البسيطة. بتطبيق هذا النظام، يسعى المشرع الجزائري إلى تحسين كفاءة النظام القضائي وتقليل فترات الانتظار الطويلة، مما يعود بالفائدة على جميع الأطراف المعنية في المنظومة القضائية. الكلمات المفتاحية : المثول ، الإيداع، السرعة في الإجراءات، النيابة العامة. Abstract: The immediate appearance system is a new legal mechanism introduced by the Algerian legislator to expedite criminal procedures in cases that do not require in-depth investigation. This system was adopted under Ordinance No. 15-02, which amends and supplements the Code of Criminal Procedure, similar to practices in other jurisdictions. Immediate appearance allows for the swift handling of cases by the competent judicial authorities. This system helps to prevent the issue of case backlog, which negatively affects the efficiency of the judicial system. Additionally, the system mandates the respect of rights and freedoms guaranteed by national and international legal texts to ensure a fair and impartial trial. It provides a rapid mechanism for handling straightforward cases. By implementing this system, the Algerian legislator aims to improve the efficiency of the judicial system and reduce long waiting periods, benefiting all parties involved in the judicial process.
