إعادة تأهيل المحبوسين من خلال الرعاية الصحية والاجتماعية في ظل قانون تنظيم السجون0504 في القانون الجزائري

الملخص
ملخص: تجمع النظم العقابية الحديثة بأن تنفيذ العقوبة السالبة للحرية في حق المحكوم عليه لا يعني الانتقام منه وإيلامه نتيجة ما اقترفه من جرائم في حق المجتمع، بل يعني سلب بعضا من حقوقه دون المساس بالحقوق المكفولة له كإنسان، في اطار معاملة عقابية ترتكز على برامج مسطرة لإعادة تأهيل المحبوسين وتحضيرهم لإعادة إدماجهم في المجتمع وقد عرفت الأنظمة الحديثة أساليب مختلفة للمعاملة العقابية داخل البيئة المغلقة من بينها الرعاية الصحية والاجتماعية للمحبوسين، وهي الأساليب التي كرسها المشرع الجزائري في نصوص القانون 05\04 بطريقة تساعد نزلاء المؤسسة العقابية على تجاوز سلبيات العقوبة السالبة للحرية من خلال احترام أدميتهم ورعايتهم صحيا، وأيضا من خلال خلق جو اجتماعي داخل محيط السجن والمحافظة على العلاقات الاجتماعية خارجه قدر الإمكان وفق أساليب مستحدثة تجعل من فترة عقوبتهم وسيلة للتأهيل والتحضير لإعادة إدماجهم في المجتمع. Abstract: Modern penal systems agree that implementing the deprivation of liberty punishment against the convict does not mean taking revenge on him and causing him pain as a result of the crimes he committed against society. Rather, it means taking away some of his rights without prejudice to the rights guaranteed to him as a human being, within the framework of punitive treatment based on structured rehabilitation programs. Imprisoned persons and preparing them for their reintegration into society. Modern systems have known different methods of punitive treatment within a closed environment, including health and social care for imprisoned persons. These methods were enshrined by the Algerian legislator in the texts of Law 04/05 In a way that helps inmates of the penal institution overcome the negatives of custodial punishment by respecting their human beings and taking care of their health, and also by creating a social atmosphere within the prison environment and maintaining social relations outside it as much as possible according to modern methods that make their sentence period a means of rehabilitation and preparation for their reintegration into society..
