Human Rights Committee: Efforts And Obstacles

Abstract
Abstract: The United Nations, and The Human Rights Committee (hereinafter called the committee) have made efforts to develop mechanisms, methods, and modalities of its work. However, the civil and political rights guaranteed by the International Covenant on civil and political rights (hereinafter called the covenant) continue to be widely violated and require increased protection. To identify the obstacles affecting task performance, we studied working rules and examined practices based on United Nations reports and databases. We have thus concluded that the number of cases before the committee and the tasks assigned to it are not commensurate with its capabilities. ملخص: بذلت الأمم المتحدة واللجنة المعنية بحقوق الانسان (تسمى فيما يلي: اللجنة) جهودا لتطوير آليات وأساليب وطرائق عملها، إلا أن الحقوق المدنية والسياسية التي يكفلها العهد المدني للحقوق المدنية والسياسية (يسمى فيما يلي: العهد) مازالت تتعرض لانتهاكات على نطاق واسع وتتطلب مزيدا من الحماية، مما استدعى منا دراسة قواعد عمل اللجنة وفحص ممارساتها للوقوف على العوائق التي تؤثر على أدائها لمهامها، خلصنا من خلال ذلك إلى أن عدم امتلاك اللجنة لآليات تنفيذية، فضلا عن كثافة القضايا والمهام المطروحة أمامها يشكلان العائقين الأساسيين الذين يؤثران على عمل اللجنة.
