أثر أصول الفقه في الصياغة القانونية لمواد قانون الأسرة الجزائري

الملخص
يتناول البحث مسألة أثر أصول الفقه في الصياغة القانونية لمواد قانون الأسرة الجزائري من زاويتين: زاوية أصولية، وأخرى قانونية من جهة الأسرة وفقهها، وهما علمان من أجلّ علوم الشريعة الإسلامية. وبين أيضا أن المقنن في استعماله للمصطلحات الأصولية التي استعان بها في صياغة بعض مواد قانون الأسرة حافظ على مدلولاتها الأصولية ولم يخالفها، كما لم يحمّلْها ما لا يستوعبها المعنى الأصولي في إطاره العام أو الخاص. وحتى المصطلحات التي يظهر للدارس أنه خالفها – على قلتها-، يكون قد خالف فيها بعض المعاني والمدلولات المشهورة لكنه لم يخالف سياقها العام، وكان ذلك في إطار الاجتهاد المحمود الذي لا يخرج عن مألوف المصطلح أصوليا.وأكد البحث على أن علم أصول الفقه لا يستغني عنه المقنن في الصياغة القانونية لمواد قانون الأسرة، لأنه يعين على فهم النصوص وتفسيرها، وتكييف الوقائع واستنباط الأحكام من الأدلة التفصيلية. : Abstract The research addresses the impact of the principles of Islamic jurisprudence (Usul al-Fiqh) on the legal formulation of the provisions of the Algerian Family Law from two perspectives: a jurisprudential one and a legal one, specifically focusing on family matters and their corresponding legal doctrines, which are among the most esteemed sciences in Islamic Sharia. It also demonstrates that, in utilizing jurisprudential terms in the drafting of certain articles of Family Law, the legislator preserved their jurisprudential meanings and did not deviate from them. Furthermore, these terms were not assigned meanings beyond their jurisprudential scope, whether in their general or specific contexts. Even in the few instances where the legislator appears to have deviated from established meanings, this deviation involved only certain well-known interpretations but did not contravene the broader context of the terms. This was done within the bounds of commendable ijtihad that does not stray from the accepted jurisprudential usage. The study emphasizes that the principles of Islamic jurisprudence are indispensable to the legislator in drafting legal provisions related to family law, as they aid in understanding and interpreting texts, classifying facts, and deriving rulings from detailed evidences.
