الملخص
ملخص: مقابل الأهمية القصوى للدور الذي يؤديه القضاء الدستوري باعتباره ضابط لحركة السلطات العامة وحماية الحقوق الحريات العامة، نجد أن له دور إنشائي يتجاوز كثيرا حدود التطبيق الحرفي لنصوص المبادئ الدستورية التي تحكم النظام السياسي والاقتصادي والاجتماعي القائم من خلال تفسيرها لنصوص الدستور والتشريعات المطعون بعدم دستوريتها. وتحقيقا للعدالة الدستورية التي يمارسها القضاء الدستوري يمكن القول أن ذلك لا يتحقق إلا من خلال توسيع المرجعية الدستورية التي تقاس عليها دستورية القوانين، بمعنى أن الرقابة الدستورية تقاس على نصوص الدستور، أو ما في حكم الدستور، وحتى النصوص التي لها قيمة أعلى من الدستور. وطبقا لما هو معمول به القضاء الدستوري المقارن، نبحث في الموازين التي يقيس بها القضاء الدستوري مدى دستورية قانون معين، على اعتبار ذلك من قبيل الالتزام بالقيود والضوابط التي تكفل ممارسة الرقابة الدستورية في إطارها القانوني الصحيح، الأمر الذي يشكل أهم دوافع نجاح القضاء الدستوري وتحقيقه لمبدأ سمو الدستور. Abstract : In contrast to the paramount importance of the role played by the constitutional judiciary as an officer of the movement of public authorities and the protection of public freedoms, it has a structural role that goes far beyond the strict application of the provisions of the constitutional principles governing the existing political, economic and social system through its interpretation of the provisions of the Constitution and the legislation contested by its unconstitutionality. In order to achieve constitutional justice exercised by the constitutional judiciary, this can be said to be achieved only through the extension of the constitutional reference to which the constitutionality of laws is measured, in the sense that constitutional control is measured against the provisions of the Constitution, the provision of the Constitution and even those of higher value than the Constitution. In accordance with the practice of comparative constitutional jurisdiction, we are examining the balances by which constitutional jurisdiction measures the constitutionality of a particular law, given that this is such as compliance with the restrictions and controls that ensure the exercise of constitutional control within its proper legal framework, which is the most important motivation for the success of the constitutional judiciary and its realization of the principle of constitutional supremacy.
