المحميات الطبيعية ودورها في تعزيز الغطاء الغابي واستدامته حظيرة القالة –الطارف- نموذجا

الملخص
الملخص: تزخر الجزائر بالعديد من المحميات الطبيعية التي تتمتع بنظام قانوني خاص، لما لها من دور فعال في حماية البيئة والحفاظ على الكائنات النادرة والمهددة بالانقراض. كما أنها تساهم بشكل كبير في تعزيز الغطاء الغابي واستدامته، وذلك لاحتوائها على أصناف متعددة من الأشجار والنباتات التي تشكل ثروة غابية تستوجب ترقيتها. لقد اهتم المشرع الجزائري بالمحميات الطبيعية من خلال وضعه جملة من التدابير الوقائية والآليات الردعية الصارمة والتي تهدف في مجملها لحمايتها من الأخطار الطبيعية والبشرية. تسعى هاته الدراسة إلى تسليط الضوء على دور المجالات المحمية في تعزيز الغطاء الغابي واستدامته، و مدى توفيق المشرع الجزائري في تجسيد الحماية اللازمة لها من خلال القوانين التي سنها لهذا الغرض. إجابة عن هذه الإشكالية وظفنا في بحثنا هذا المنهجين التحليلي والوصفي، مدعمين الجانب النظري بدراسة تطبيقية عن حظيرة القالة – الطارف نموذجا. وذلك لما تزخر به هذه المحمية من ثروة حيوانية، نباتية وغابية معتبرة، وكذلك للدور الفعال الذي تلعبه في الحفاظ على التراث الغابي واستدامته. كما خلصت الدراسة إلى جملة من النتائج والتوصيات أهمها تفعيل مواد القانون خاصة فيما يتعلق بتدابير الحماية سواء الوقائية أو الردعية، هذا فضلا عن إدراج الانشغال المتعلق بضرورة وجود ضبطية قضائية مختصة في مجال المحميات الطبيعية وقضايا البيئة. Abstract: Algeria is blessed with numerous natural reserves that have their own specific legal framework, owing to their significant role in environmental protection and conservation of rare and endangered species. They also greatly contribute to enhancing forest cover and its sustainability due to their diverse varieties of trees and plants, which constitute a forest wealth worthy of development. The Algerian legislator has emphasized the importance of natural reserves by implementing a range of preventive and stringent deterrent measures aimed at protecting them from both natural and human threats. This study seeks to shed light on the role of protected areas in promoting and sustaining forest cover, and to what extent the Algerian legislator has embodied the necessary protection by enacting laws for natural reserves. To address this issue, we adopted an analytical and descriptive approach, supported by a theoretical perspective and an empirical study of Al KALA - Taref Reserve as a model. This is due to the rich fauna, flora, and forest wealth found in this reserve, as well as its effective role in preserving and sustaining forest heritage. The study has concluded with a set of findings and recommendations, the most important of which include activating legal provisions, especially regarding protective and deterrent measures. Additionally, there's a need to address the existence of specialized judicial oversight in the field of natural reserves and environmental issues.
