المستجدات الطبية في ضوء الفقه الإسلامي "زراعة الأعضاء البشرية أنموذجا"

الملخص
يعد الطب من أشرف العلوم التي لها علاقة بالإنسان، فشهد تطورا كبيرا خاصة في مجال العمليات الجراحية، حيث غدت العمليات الكبرى صغرى، حتى رأينا أعضاء تنقل من أشخاص إلى آخرين، من أجل الحفاظ على صحة الإنسان، لأن غاية الطب حفظ الصحة الموجودة، أو استعادة العافية المفقودة، أو إزالة العلة وتقليلها قدر الإمكان، ويعد المجال الطبي بما حمله من مستجدات معاصرة أحد أبرز الدراسات التي شهدت قفزة علمية متطورة استدعت ضرورة وجود رؤيا شرعية ثاقبة لإيجاد التكيف الفقهي والحكم الشرعي المناسب لها، ومن أهم التطورات التي شهدها العالم اليوم هي المستجدات الطبية المتمثلة في نقل وزراعة الأعضاء الآدمية، التي أدت إلى اختلاف الفقهاء في حكمها وهو ما سنحاول في هذه المداخلة من بيان لأقوال الفقهاء في هذه المسألة وأدلتهم ومناقشتها للوصول إلى الرأي الراجح الذي يتماشى وروح الشريعة. Medicine is one of the most honorable sciences related to human beings. This science has witnessed a great development especially in the field of surgical operations, where major operations became small. In order to preserve human health, organs are moved from one person to another, because the goal of medicine is to preserve existing health, restore lost wellness, remove or reduce the bug as much as possible. The medical field with its contemporary developments is one of the most notable studies that saw a sophisticated scientific leap that necessitated the need for an insightful legitimate vision to find both legal adaptation and appropriate legal judgment for it. One of the most important developments in today's world is the medical developments of human organ transplantation, which led to differences in the jurisprudence of the scholars. In this intervention, we will try to make a statement of the jurisprudence in this matter and their evidence and discussion in order to reach the prevailing opinion that is in line with the spirit of sharia.
