القبض الحكمي صوره وتطبيقاته المعاصرة

الملخص
يتناول هذا البحث أحد العناصر المالية الهامة التي صارت مناطا لأنظار الباحثين في العصر الحديث، لأن المقصد الأساسي من تشريعه هو التمكن من التصرف في المعقود عليه، تمكنا اختلف باختلاف الزمان والمكان والوسائل المتخذة لتحقيق مصالح الناس، ومدار ذلك كله هو العرف وما ينبني عليه من أحكام ثابتة في أصولها وقواعدها متغيرة ومتنوعة في تطبيقاتها. وكما هو معلوم أن المال عديل الروح ووسيط للتبادل وحيازته إنما تتم عن طريق التقابض والاستيفاء إذا كان قبضا حقيقيا، وقد يكون قبضا حكميا وهو محل هذه الدراسة. ولذا لابد من معرفة القبض من حيث مفهومه وبيان حقيقة مشروعيته، ثم توضيح القبض الحكمي وصوره وتطبيقاته المعاصرة عملا بالقاعد:" العلم بالشيء فرع عن تصوره". This research deals with one of the significant financial elements that became the center of attention of researchers in the modern age. Since the main purpose of its legislation is to be able to act in the contract, we were able to differ according to time, place and means taken to achieve the interests of the people. The orbit of all that is custom and the provisions that build on it Fixed in its assets and rules variable and diverse in their applications.. It is very common that the money is equated to a spirit and a mediator for exchange and its possession is done through interdependence and interpolation if it is a real arrest. It may be a judgmental arrest is the subject of this study. Therefore, it is necessary to know the arrest in terms of its concept and to clarify the truth of its legitimacy, then clarify the arbitrary arrest and its contemporary images and applications pursuant to the rule: "Science is something branch of his perception."
