التوقيع الإلكتروني كوسيلة لإثبات المعاملات الإدارية الإلكترونية Electronic Signature As A Means To Prove Electronic Administrative Transactions

الملخص
الملخص: غير التطور العلمي الهائل والمتسارع في مجال تكنولوجيا المعلومات ووسائل الاتصال الحديثة أساليب وآليات إبرام التصرفات القانونية، وأفرز نوعا جديدا من المعاملات التي تتم في واقع غير ملموس عبر وسائط إلكترونية تحمل توقيعا إلكترونيا. وقد أصبحت هذه المعاملات الإلكترونية بمختلف أنواعها أحد أهم مميزات العصر الحديث، وهو الأمر الذي أصبحت معه الوسائل التقليدية للإثبات عاجزة عن مواكبة هذا التطور التكنولوجي، ولإضفاء نوع من الثقة والأمان على المعاملات الإلكترونية استوجبت الضرورة وضع قوانين جديدة تتماشى وطبيعة المحرر الإلكتروني والتوقيع الالكتروني الذي حل بديلا للتوقيع التقليدي، وتمنحهما الحجية في الإثبات. Abstract: With the tremendous and rapid scientific advancement in the field of information technology and modern means of communication, new methods and mechanisms for conducting legal transactions have emerged, resulting in a new type of transactions that take place in a virtual environment through electronic mediums carrying an electronic signature. These electronic transactions, in their various forms, have become one of the most important features of the modern era. Traditional means of proof have become inadequate to keep up with this technological advancement. To instill a sense of trust and security in electronic transactions, the necessity arose to establish new laws that align with the nature of the digital era.
