إنعقاد الزواج وآثاره في التشريع الأسري الجزائري بين الثابت والمعدل

الملخص
نهدف من خلال دراستنا لموضوع إنعقاد الزواج وآثاره في التشريع الأسري الجزائري بين الثابت والمعدل إلى معرفة الإطار المفاهيمي لإنعقاد الزواج في القانون الجزائري، وذلك من خلال التطرق إلى تعريف الخطبة وطبيعتها القانونية وحكمها، ثم التطرق إلى إلزامية الفحص الطبي قبل الزواج في القانون الجزائري وتعريفه وانواعه وإلى شروطه وإلزامية الشهادة الطبية قبل عقد الزواج، كما نهدف أيضا إلى معرفة آثار إنعقاد الزواج في التشريع الجزائري، وذلك من خلال التطرق إلى الآثار المتعلقة بتخلف ركن و شرط وما ينتج عنه من إبطال للعقد أو فسخه بسبب الإكراه و التدليس وغيرها من العيوب، وكذلك التطرق إلى الآثار المتعلقة بحقوق وواجب ات الزوجين، ثم إلى الآثار المرتبطة بإثبات النسب. We aim through our study of the issue of the marriage contract and its effects in the algerian family legislation between the fixed and the average to know the conceptual framework for the contract of marriage in the algerian family legislation,by addressing the definition of the engagement and its legal nature and its ruling,then addressing the mandatory medical examination befor marriage in the algerian legislation and its definition,types and condition,and we also aim to know the effects of the marriage contact in algerianlegislation,by addressing the effects related to the failure of the pillar and the condition and the resulting nullification or termination of the contact due to coercion,frand or other defects,as well as addressing the effects related to rights and duties the spouses,then to the effucts related to the proof of parentage.
