الآليات الإجرائية لمكافحة الاتجار بالأعضاء البشرية في الدول المغاربية

الملخص
ملخص: اتسمت السياسة الزجرية المعتمدة من قبل الدول المغاربية في مكافحة جريمة الاتجار بالأعضاء البشرية بالقصور في بعض مواطنها، ويعود ذلك إلى عدم تطابق القوانين المجرمة مع تفشي هذه الظاهرة لأنها تجاوزت الأركان الشرعية التقليدية لكونها جريمة متشعبة تتخفى تحت أوصاف جرائم أخرى، فلها علاقة بالاتجار بالأطفال وتبييض الأموال والهجرة غير الشرعية والمخدرات، وعلاقة خاصة مع الاتجار بالبشر، فتجريم الاتجار بالأعضاء البشرية بثلاث أركان لا يتطابق مع ما تفرضه طبيعة هذه الجريمة في الواقع، فقد عجزت هذه التشريعات على حسن تأطيرها واستيعابها بكامل أركانها الباطنية التي قد تتجاوز ما هو مألوف قانونا ألا وهو الركن الشرعي والركن المادي والركن المعنوي.إضافة إلى أن عدم وجود نص عقابي يجرم الاتجار بالأعضاء البشرية بصورة مستقلة على مستوى التشريع التونسي يمثل ثغرة في السياسة العقابية التونسية وقد تكون هذه الثغرة أحد أسباب قصور السياسة الزجرية على مستوى الدول المغاربية خاصة في ظل غياب تعاون مغاربي يهدف إلى الحد من هذه الظاهرة The repressive policy adopted by the Maghreb countries in combating the crime of trafficking in human organs was characterized by shortcomings in some of its locations, due to the inconsistency of the criminal laws with the spread of this phenomenon because it exceeded the traditional legal pillars because it is a complex crime disguised under the descriptions of other crimes, as it is related to child trafficking and money laundering. And illegal immigration and drugs, and a special relationship with human trafficking, criminalizing trafficking in human organs with three pillars does not correspond to what is imposed by the nature of this crime in reality, as these legislations were unable to properly frame and absorb them in all their inner pillars that may go beyond what is familiar legally, which is the legal pillar In addition, the absence of a punitive text that criminalizes trafficking in human organs independently at the level of Tunisian legislation represents a loophole in the Tunisian punitive policy. from this phenomenon
