القواعد الدولية و سلطانها في مجال الاتفاقيات غير المتكافئة: الشراكة بين الجزائر والاتحاد الأوروبي نموذجا

الملخص
ملخص: تهدف هذه الدراسة إلى ابراز طبيعة الشراكة الأوروجزائرية والوقوف على حيثياتها، وَمدى عمل الطرفين- الجزائري والأوروبي- بقواعد القانون الدولي وفقا لما جاء في بنود الاتفاقية نفسها. ووصلت الدراسة لمجموعة من النتائج منها التأكيد على تحول الشراكة بين الجزائر والاتحاد الأوروبي من شراكة حقيقية لها أبعادها الاقتصادية، الاجتماعية، السياسية، الثقافية وحتى الأمنية، لتحقيق تنمية مستدامة من خلال دور المؤسسات والاستثمارات الأجنبية والتبادل التجاري الحر، إلى كابوس حقيقي من خلاله وقفت الجزائر على حقيقة وواقع بعيد عما كانت تطمح له، ما يستوجب معه إعادة النظر فيما تم الاتفاق عليه من بنود في اتفاقية الشراكة بينها وبين دول الاتحاد الأوروبي، برؤية نظرية واقعية وخاصة قانونية وبمقاربة براغماتية تخدم مصالحها هي الأخرى. Abstract: This study aims to highlight the nature of the Euro-Algerian partnership and to determine its merits, and the extent of the work of the two parties- Algerian and European- according to the rules of international law in accordance with the terms of the agreement itself. The study reached a set of results, including the confirmation of the transformation of the partnership between Algeria and the European Union from a real partnership that has its economic, social, political, cultural and even security dimensions, to achieve sustainable development through the role of foreign institutions and investments and free trade, to a real nightmare through which Algeria stood on a fact and reality far from what it aspired to, which necessitates reconsidering the terms agreed upon in the partnership agreement between it and the European Union countries, with a realistic theoretical and private legal vision and a pragmatic approach that serves its interests as well.
