العجز الدائم الناتج عن حادث العمل وإختصاص لجنة العجز الولائية المؤهلة في حل منازعاته الطبية.

الملخص
ملخص: إن التطورات الاقتصادية و الاجتماعية التي أتت بها الثورة الصناعية للمجتمعات الرأسمالية زادت من الأخطار المهنية التي أصبحت الطبقة العمالية أكثر الطبقات تعرضا لها ،ما فرض على أنظمة الدول تأمين هذه الأخطار ومن بينها إصابات العمل ووضع قواعد قانونية لتعويض العامل ، وعلى غرار تسارع وتيرة هذه المتغيرات وضع المشرع الجزائري نظاما خاصا لتعويض العامل المصاب اثر حادث العمل بدءا بتعويضه عن العجز المؤقت وكذا العجز الدائم في حالة عدم شفائه،غير أن هذا التعويض قد يثور حوله نزاعا بين المؤمن له اجتماعيا و هيئة الضمان الاجتماعي ، حيث وضع المشرع الجزائري الطعن الإداري من المحاور الأساسية التي يدور في فلكها قانون منازعات الضمان الاجتماعي وكذا آلية من آليات تسوية الخلافات الناشئة عن حوادث العمل ومنها تلك المتعلقة بالعجز الدائم الذي قد يصيب العامل ، وتعد منازعات طبية تختص بالفصل فيها قبل اللجوء إلى القضاء لجنة العجز الولائية المؤهلة. Abstract: The economic and social developments brought by the industrial revolution to the capitalist societies have increased the occupational hazards, which the working class became more exposed to than any other class. This imposed on state systems to insure against these hazards, including work-related injuries, and establish legal frameworks for compensating workers. Following the accelerating pace of these changes, the Algerian legislator has established a special system for compensating injured workers following workplace accidents, starting with compensating them for Temporary Disability as well as Permanent Disability in case of non-recovery. However, this compensation may raise a dispute between the insured person and the social security body. The Algerian legislator has made the administrative appeal one of the main axes around which the Social Security Disputes Law revolves, as well as a mechanism for settling disputes arising from work accidents, including those related to Permanent Disability that may affect the worker. Medical disputes concerning these matters are adjudicated by the qualified provincial disability committee before resorting to the judiciary.
