" ماهية تنظيم السُّلوك البرلمانيِّ: دراسة مقارنة" " The Essence Organization Of Parliamentary Conduct: A Comparative Study"

الملخص

تناقش هذه الدراسة الموسومة بـ “ماهية تنظيم السلوك البرلماني: دراسة مقارنة" جوهر السلوك البرلماني؛ لذا فإن هذه العنونة، تستلزم فحص وتحديد مصطلح السلوك البرلماني وتعريفه، وتحديده، وتمييزه من غيره من المفاهيم، وبيان الأطر القانونية الناظمة له، وبذلك، تتناول الدراسة في مبحثين، معالجة ماهية تنظيم السلوك البرلماني: "مفهوم مدونة السلوك البرلماني" في المبحث الأول، ومبادئ ومعايير السلوك البرلماني" في المبحث الثاني. ولقد اتبعت الدراسة منهج التحليل القانوني المقارن، للبحث في إشكالية الدراسة التي تتناول ماهية السلوك البرلماني، والمبادئ والمعايير التي تنهض بهذا السلوك، وتوصلت الدراسة إلى عدد من النتائج؛ أهمها قصور المشرع الأردني عن إدراك هذه الماهية، مما أفقد مدونة السلوك النيابية جوهرها. .Abstract : This study, tagged " The essence organization of parliamentary conduct: a comparative study", therefore, needs to examine the definition and limited of parliamentary conduct, its identification and differentiation from other concepts, and the statement of the legal frameworks governing it. Thus, the study examines, in researchers, what is the organization of parliamentary conduct: "The concept of a parliamentary code of conduct" in the first section, and the principles and criteria of parliamentary conduct, in the second section. The study followed a comparative legal analysis approach to examine the problem of the study on what parliamentary conduct is, the principles and criteria that promote such conduct, and reached a number of result; The most important of these is the failure of the Jordanian legislature to recognize this anomaly, which has lost its essence in the parliamentary code of conduct.
