الملخص

ملخص: تتضمن هذه الدراسة البحثَ عن دليل من الأدلة الشرعية المسمى دليل العرف، ومدى أثره في تحقيق التجديد وإظهار صلاحية الشريعة لمواكبة التطورات والتغيرات النازلة التي تشهدها المجتمعات، وعدم الجمود فيما أنيط به من أحكام، وتبين مجال عمله وشروط إعماله، موضحا كونه من القواعد المشتركة النافذة في علمي القواعد الفقهية وأصول الفقه، مستصحبا مع ذلك نموذجا حيا لإعماله من زبدة علماء الجزائر. الكلمات المفتاحية: العرف؛ العادة محكمة؛ التجديد، الخطاب الشرعي؛ جمعية العلماء المسلمين. Abstract: This study includes searching for a piece of legal evidence called The Evidence of Custom, and the extent of its impact in achieving innovation and demonstrating the suitability of Sharia to keep pace with developments and ongoing changes. In which societies are witnessing, and not to be rigid in the rulings entrusted to it. Moreover, to clarify the scope of its work and the conditions for its implementation. Explaining that it is one of the common rules in force in teach the jurisprudential rules and principles of jurisprudence, along with living example of its implementation from the core of Algerian scholars. key words: Custom, Custom is tight, renewal, the religious speech, Association of Muslim scholars.
