النقود الرَقَميَّة الـمُشفّرة وحكمها الشَرْعِيّ

الملخص
اهتم البحث بالكشف عن الإشكالات الشرعيّة المؤثرة في الحكم على النقود الرَّقميَّة الـمُشفّرة، وقد افتتح ببيان مفهومها والتقنية التي تعتمد عليها وأنواعها، ثم عرضًا لتلكم الإشكالات وآراء العلماء في مدى تأثيرها على الحكم الشرعي، ليخلص البحث في الأخير أنّ هناك إشكالات قد تجاوزتها النقود المشفّرة ولم تعد محل نقاش كصفة المالية والنقدية فهي متحققة فيها والواقع يشهد ذلك، وكون أنّها غير مستقرة القيمة لا ينفي عنها صفة النقدية وإنّما يُخفض من كفاءتها كنقد، وأمّا ما يتعلق بغياب الضمان والثقة الذي تمنحه الحكومات فطرح هذا الإشكال قد يكون طمسًا لطبيعتها وصفتها التي تتميّز بها في كون نظامها والتقنية التي تعتمد عليها هي البديل والعوض عن الضمان التي تمنحه الحكومات أو مؤسساتها المالية، وبالنسبة لبقية الإشكالات فالأمر يتطلب وضع الضوابط والبدائل الشرعية الممكنة التي تخفف من تأثيرها وتجعلها تتوافق مع قواعد الشريعة الإسلامية. The research aims to reveal the legal problems affecting the ruling on Cryptocurrency and the extent of its impact. This research started with a statement of the concept of Cryptocurrency, the technology that depends on it and its types, then a presentation of the legal problems and the points of views of scholars on the extent of their impact on the legal ruling. We concluded that there are problems that have been overcome by Cryptocurrency and are no longer under discussion, as the financial and monetary quality, as it is realized in it, and the reality is that it is unstable, and the fact that it is unstable in value does not negate the monetary character from it, but rather reduces its efficiency as cash. This fact is distinguished by the fact that its system and the technology on which it relies is an alternative and a substitute for the guarantee granted by governments or their financial institutions. As for the rest of the problems, the matter requires setting possible legal controls and alternatives that mitigate its impact and make it compatible with the foundations of Islamic Sharia.
