أبو القاسم ابن الجلاب وجهوده في تأسيس القواعد الفقهية من خلال كتابه التفريع.

الملخص
حاز مالكية العراق بالسبق إلى جمع شتات الجزئيات الفقهية في قواعد كلية تضبط فروع الأحكام ونظائرها، سواء بإفرادها بالتصنيف، أو الاقتصار على التعرض لها في تحرير المسائل وتفصيلها كما فعل ابن الجلاب في كتابه «التفريع»، فيلاحظ أنه يعرض المسألة ثم يصرح بحكمها، ويعمد إلى استخلاص قاعدة تجمع شتات المسائل المنضوية تحتها، ولهذا المرام جاءت هذه المقالة لمعالجة إشكالية مدى سبق ابن الجلاب إلى صياغة القواعد الفقهية وعنايته المبكرة به، من خلال كشف القواعد التي يصوغها في كتابه، والبحث يدرس علم القواعد الفقهية ودور الشيخ في تأسيسه، لإثبات عنايتة بهذا الفن ومساهمته في وضع لبناته الأولى، موظفا في ذلك المنهج الوصفي والتحليلي، وسيأتي الكلام عنه في ثلاثة مباحث، الأول: ترجمة ابن الجلاب، وتعريف موجز لكتابه، والثاني: جهوده في التقعيد الفقهي. والثالث: منهجه في التقعيد الفقهي. وانتهى البحث إلى حيازة المالكية سبق التأسيس لفن القواعد الفقهية موازاة مع الأحناف، كما أن الشيخ ابن الجلاب له إسهام في تأسيس القواعد الفقهية. The Maliki School in Iraq has been distinguished by its pioneering efforts in systematically consolidating scattered jurisprudential details and their endless branches into comprehensive principles that regulate the branches of judgments and their counterparts. This is evident whether by isolating them in classifications, as seen in works such as "Al-Furuq fi Masa'il al-Fiqh" by Judge Abdul Wahhab, and "Al-Furuq al-Fiqhiyyah" by Abu al-Fadl Muslim ibn al-Damascene, or by merely addressing them in the exposition and elaboration of issues, as Abu al-Qasim ibn al-Jallab did in his book "At-Tafri'." He is among the earliest scholars to engage in the art of juristic categorization. It is noteworthy that he presents the issue from various perspectives before declaring its ruling, and then proceeds to derive a principle that consolidates the scattered issues falling under it. The book contains a plethora of jurisprudential principles embedded within its pages, demonstrating his meticulous attention to the art of jurisprudential principles. Hence, this article aims to unveil these principles in Ibn al-Jallab's work to underscore his early dedication to this field of knowledge, by introducing him and his book, and subsequently revealing the principles he formulates within the folds of his juristic categorization. The research investigates the science of jurisprudential principles and Ibn al-Jallab's role in its establishment, through description and analysis, to prove the sheikh's care for this art and his contribution to laying its foundational groundwork. Employing a descriptive and analytical approach, the discussion in this study will be divided into three main sections: Firstly, the translation of Sheikh Abu al-Qasim ibn al-Jallab's work, along with a brief introduction to his book "At-Tafri'." Secondly, an exploration of Ibn al-Jallab's efforts in juristic categorization. Lastly, an examination of Ibn al-Jallab's methodology in juristic categorization.
