مظاهر تدويل معايير العمل في تشريعات العمل الجزائرية

الملخص
إن سمو القانون الدولي على القوانين الداخلية لا سيما في مجال حقوق الإنسان وحرياته أصبح واقعا حتميا، و من مخرجاته بروز ظاهرة التدويل التي تعني إخراج هذه الحقوق من سلطان الدول و إعادة انفاذها ضمن المنظومات القانونية الوطنية، و من أهم هذه الحقوق حقوق العمال أو معايير العمل الدولية التي تعد نماذج راقية للحقوق العمالية تسعى لحماية العمال وبلوغ أسمى أهداف العمل، و الجزائر كغيرها من الدول صادقت على الكثير من الاتفاقيات الدولية للعمل لاسيما الأساسية وذات الأولوية منها و عملت على دمجها و إنفاذها ضمن تشريعاتها الوطنية، ما مكَّنها من تقنين و تنظيم كل قطاع العمل و استدراك جل النقائص، كما أن العديد من المعايير تعد مبادئ دستورية تسندها مبادئ أخرى كترتيب المعاهدات بعد الدستور و الزام القضاء بالحكم بها. The supremacy of international law over domestic laws, especially in the field of human rights and freedoms, has become an inevitable reality, and one of its outcomes is the emergence of the phenomenon of internationalization, which means removing these rights from the jurisdiction of states and re-enforcing them within national legal systems, and among the most important of these rights are workers’ rights or labor standards. International labor agreements are considered high-end models of labor rights that seek to protect workers and achieve the highest work goals. Algeria, like other countries, has ratified many international labor agreements, especially the basic and priority ones, and has worked to integrate and enforce them within its national legislation, which has enabled it to codify and regulate All work sectors and correct most of the shortcomings, and many of the standards are constitutional principles supported by other principles, such as arranging treaties after the constitution and obliging the judiciary to rule by them.
