الملخص
ملخص: نصت معظم التشريعات على أن التجارب الطبية تتم وفقا لضوابط أخلاقية، أدبية، وشرعية. ومن أهم تلك الضوابط والضمانات هو ضرورة الحصول على رضا خاص صريح يحول دون إهانة الشخص الخاضع للبحث الطبي أو المساس بكرامته أوتعريض حياته للخطر، فلا يباح أي عمل طبي أو تجريب علمي من شأنه المساس بالسلامة الجسدية أو النفسية للإنسان إلا بإذنه ورضاه صراحة. لذلك سنسلط الضوء من خلال هذه الورقة البحثية على مضمون الرضا في التجارب الطبية و جزاء تخلفه و ذلك في إطار دراسة مقارنة. الكلمات المفتاحية: التجارب الطبية؛ الرضا الصريح؛ الرضا الحر؛ الدراسات العيادية؛ البحث. Abstract: Most legislation stipulates that medical experiments are carried out in accordance with ethical, moral, and legal controls. One of the most important of these controls and guarantees is the necessity of obtaining express, specific consent that prevents the person subject to medical research from being insulted, his dignity being harmed, or his life being endangered. No medical work or scientific experimentation that would affect a person’s physical or psychological safety is permitted except with his explicit permission and consent. Therefore, through this research paper, we will shed light on the content of satisfaction in medical experiments and the penalty for its failure, within the framework of a comparative study. key words: medical experiments; express consent; free consent; Clinical studies; search.
