الفتوى بين المصالح الحقيقية والمصالح الوهمية

الملخص
ملخص: المصالح المنظور إليها في الأحكام والفتاوى ليست على درجة واحدة من الوضوح، فهناك مصالح قطعيّة، وهناك مصالح ظنيّة، وهناك مصالح وهميّة. وقد تخفى على المفتي وجوه دقيقة من المصلحة الشرعية، لذلك يجب عليه معرفة ضوابط اعتبار المصالح، لتقديم المصالح الراجحة على المرجوحة، وتمييز المصالح المعتبرة شرعا من الأوهام التي قد تبدو لأول النظر مصالح، ثم عند التحقيق تظهر وهميّة لا تصلح لبناء الأحكام والفتاوى عليها. وفي هذا البحث بيان لضوابط التفرقة بين المصالح المعتبرة والمصالح الوهميّة من حيث المفهوم ومن حيث التعامل والتوظيف، والأثر الإيجابي لاعتبار المصالح الحقيقية في الفتوى، والأثر السَّلبي لاعتبار المصالح الوهميّة في ذلك. الكلمات المفتاحية: الفتوى؛ المصلحة؛ المصالح الحقيقية؛ المصالح الوهميّة. Abstract: The interests considered in rulings and "fatwa" are not at the same level of clarity. There are definitive interests, there are presumptive interests, and there are placebo interests. Accurate aspects of the legitimate interest may be hidden from the "mufti". so he must know the controls for considering the interests, to give preference to the preponderant interests over the preponderant ones. and to distinguish the legitimate interests from the illusions that may appear to the first consideration as interests. then upon investigation they appear illusory and not suitable for building rulings and "fatwa" on them. In this research, a statement of the controls for distinguishing between considered interests and placebo interests in terms of concept and in terms of dealing and employment, and the positive impact of considering real interests in the "fatwa", and the negative impact of considering placebo interests.
