التوسع في القانون الدولي: اختلاف الرؤى العالمية - دراسة تحليليّة -

الملخص
ملخص: منذ نشأته تطور القانون الدولي وتوسع بشكل قد يصعب معه جمعه تحت مظلةٍ واحدة، ثم إن التوسع والذي كان نتيجةً طبيعيةً لتزايد وتباين احتياجات المجتمع الدولي بدأ بالتفاقم بشكل خارج عن السيطرة، فكان لكل مجال مختص بأحد أفرع القانون الدولي أجهزة ومؤسسات تنشق منه وكان لها بدورها كيان مستقل عن غيرها، فغدى القانون الدولي متشابكاً، ذلك الاستقلال الذي تبعه التجزؤ في قواعد القانون الدولي خلَّفَ نتائج كان لها أثر في تغيير شكله حتى وصوله إلى شكله الحاليّ. وأيضاً وبسبب العولمة والترابط العالمي أصبحت جميع نواحي الحياة مترابطة بعضها ببعض، غدى القانون الدولي كنقطة في منتصف دائرة موصولة بعدة توجهات اجتماعية، سياسية، انسانية، اقتصادية، بيئية وغيرها، حيث أن الفاعلين على مختلف الأصعدة تتباين مصالحهم ومواقفهم والرؤى المستقبلية الخاصة بهم والتأثير الكبير الذي يخلفه ذلك واضح خصوصاً اذا كان الفاعلون من القوى العظمى والمؤثرة عبر شكل سريان القواعد فيما يحدث في العالم، تهدف هذه الدراسة إلى البحث وراء أسباب ذلك التوسع والتجزؤ المرتبط والمتزامن معه، كيف ومتى بدأ والأثر الذي امتدّ إليه. Abstract: Since its genesis, international law has developed and expanded in a way that made it difficult to be collected in one place, the expansion which was a natural result of the increasing and diversity of the needs of the international community began to exacerbate out of control. Each field specialized in one of the branches of international law had organs and institutions that split from it ended up with independent entity from others, what made it intertwined, that independence followed by fragmentation of the rules of international law left with results that had an impact on changing its form until it reached out the current known form. Therefore, and due to globalization and global interdependence, all its aspects had become connected to each other to several social, political, humanitarian, economical, environmental and other trends, as the actors at various levels differ in their interests, positions and future visions. This study aims to investigate the reasons behind the expansion and the fragmentation associated with it, how and when it began and the impact that had been left.
