Abstract
Abstract : The advancement of human intellect has transcended the mere development of machines and tools that simplify life, advancing towards the creation of entities endowed with sophisticated forms of intelligence. These entities are gradually attaining a level of autonomy, heralding the rise of artificial intelligence (AI) as a distinct phenomenon. This progression poses significant legal conundrums, particularly concerning the compensation claims by those harmed by AI actions. Various solutions have been proposed, including the conferment of legal personhood upon AI, thereby making it liable for any damages it incurs and subjecting it to potential criminal sanctions for legal infractions. Nevertheless, these propositions face considerable hurdles, sparking an intense and ongoing debate about their implementation. ملخص: لم يتوقف ذكاء الإنسان عند اختراع آلات ومعدات تساعده على أمور الحياة، بل تعداه إلى اختراع كيانات جد متطورة تتصف هي أيضا بالذكاء، وأصبحت تستقل عن مستخدميها شيئا فشيئا، في ظاهرة جديدة فسحت المجال لتبني ما يسمى بالذكاء الاصطناعي. أدى ظهور تلك الكيانات الذكية، ذاتية التحكم، والمستقلة نسبيا عن مستخدميها، إلى ظهور صعوبات كثيرة واجهت فئة المضرورين عند مطالبتهم بالتعويض عن الأضرار التي أحدثتها لهم تلك الكيانات، تمثلت بعض الحلول المقترحة في ضرورة الاعتراف للذكاء الاصطناعي بالشخصية القانونية، وبالتالي قابلية مساءلته قانونيا وإلزامه بالتعويض عن الأضرار التي يتسبب فيها، وإمكانية تحمله للجزاء الذي تفرضه القواعد القانونية الجنائية بسبب خرقه للأحكام التي تقررها هذه القواعد، الأمر الذي وقفت في وجهه تحديات كبيرة ما زال النقاش محتدما حولها إلى الآن.
