الملخص
الملخص: تناولت هذه الدراسة واقع التفسير في القضاء الدستوري الجزائري، كقاطرة أساسية لتجلي ما يكون قد ران على النص التشريعي من غموض وتعارض، وهذه العملية غاية في التعقيد تحتاج لإحاطتها بمجموعة من الحدود والضوابط لكي لا يأخذ التفسير طريق التعديل، وعلى القاضي الإلتزام بها بما يحقق الإرادة الحقيقة لواضعي الدستور وبما يضمن عدم الإنحراف عنها، حمايةً لسمو القاعدة الدستورية واستقرارًا لها، وتجنبا للإصطدام مع السلطتين التنفيذية والتشريعية، وهذه التحديات تتطلب زمنا كافيا لترصينها من أجل الحكم على مدى فعاليتها في ضبط العمل التفسيري. Controls and limits of the constitutional judge in interpreting legislation Summary: This study dealt with the reality of interpretation in the Algerian constitutional judiciary, as a basic driver for clarifying the ambiguity and contradiction that may have appeared in the legislative text, This process is extremely complex, and needs to be surrounded by a set of limits and controls so that the interpretation does not take the path of amendment, and the judge must adhere to it in a way that achieves The true will of the drafters of the constitution and what guarantees that it will not deviate from it, is to protect the supremacy and stability of the constitutional rule, and to avoid clashes with the executive and legislative powers, These challenges require sufficient time to consolidate them in order to judge the extent of their effectiveness in controlling the interpretive work. Contrôles et limites du juge constitutionnel dans l'interprétation de la législation Résumé: Cette étude a porté sur la réalité de l'interprétation dans le système judiciaire constitutionnel algérien, comme moteur fondamental pour clarifier l'ambiguïté et la contradiction qui ont pu apparaître dans le texte législatif, Ce processus est extrêmement complexe et doit être entouré d'un ensemble de limites et contrôle pour que l'interprétation ne prenne pas la voie de l'amendement, et le juge doit s'y conformer, de manière à réaliser La véritable volonté des rédacteurs de la constitution et ce qui garantit qu'elle ne s'en écartera pas, est de protéger la suprématie et la stabilité de la règle constitutionnelle, et pour éviter les conflits avec les pouvoirs exécutif et législatif, Ces défis nécessitent suffisamment de temps pour les consolider afin de juger de l'étendue de leur efficacité dans le contrôle du travail interprétatif.
