عقدٌ من صدور نظام التحكيم السعودي 2012م: المخرجات والتطلعات

الملخص
يضع هذا البحث ملخص النتائج، والمخرجات، والتطلعات عقب إصدار نظام التحكيم السعودي لعام ١٤٣٣ه الموافق ٢٠١٢م. حيث يُستعرض فيه أهم الإنجازات التي حدثت في التشريع التحكيمي السعودي والممارسات التحكيمية على مستوى الممارسين القانونيين والمُحَكَمِين، كما يُسلط الضوء على دور الأجهزة الحكومية في المملكة العربية السعودية بشأن تفعيل التحكيم الإداري واتخاذه أداة لحل المنازعات التي يمكن أن تطرأ بين الجهة الحكومية و المتعاقد معها. ويركز هذا البحث على الإنجاز الكبير الذي حققه المنظم السعودي بعد صياغة نظام ٢٠١٢ مقارنة بنظام التحكيم السابق وما فيه من إيجابيات كثيرة. وأخيرا يختم هذا البحث بعرض أبرز التطلعات المنشودة عقب أكثر من 10 سنوات من صدور نظام التحكيم ٢٠١٢ ومدى الحاجة إلى وجود نظام جديد متوافق مع التطورات والتغيرات المميزة في البلد. This research presents a summary of the results, outputs, and prospects following the issuance of the Saudi Arbitration System in 1433 AH (2012 AD). It reviews the most significant achievements that have occurred in Saudi arbitration legislation and arbitration practices at the level of legal practitioners and arbitrators. It also highlights the role of government bodies in the Kingdom of Saudi Arabia in activating administrative arbitration and utilizing it as a tool for resolving disputes that may arise between the government entity and its contractors. This research focuses on the significant progress achieved by the Saudi regulator after formulating the 2012 system compared to the previous arbitration system and its numerous advantages. Lastly, this research concludes by presenting the key desired prospects following more than 10 years since the issuance of the 2012 Arbitration System and the need for a new system that is compatible with the distinctive developments and changes in the country.
