بيع الكلاب البوليسية المدربة دراسة فقهية أصولية The Sale Of Trained Police Bloodhounds A Fundamental Doctrinal Study

الملخص
ملخص البحث: يتغيَّا هذا البحث كشفَ اللثام عن مسألة فقهية مستجدة، وهي مسألة: "بيع الكلاب (البوليسية) المُدَرَّبَة" وما تطوَّر فيها من تنوعٍ في استخداماتها؛ مثل: الأمن، والحراسة، ومطاردة المجرمين، والتعرف على الأشخاص المشتبه بهم، والكشف عن المخدِّرات، والمتفجِّرات، والسَّرقات، وإنقاذ الأرواح، إلى غير ذلك من الأمور التي تشجِّعُ كثيراً من الدول على شرائها، واستخدامها في المحافظة على الأمن واستتبابه، والاستفادة منها في كثير من المجالات، فالحاجة داعية إلى إعادة النظر في مناط المسألة؛ ودراسة أدلتها الشرعية، الأصيلة منها والتبعية، وقواعدها الفقهية والأصولية، ومناقشتها، لاستخراج الحكم الشرعي المناسب، وقد سلك البحث المنهج الاستقرائي، والتحليلي، وتأدَّى إلى نتائج عدة، منها: 1. أنَّ الكلاب (البوليسية) المُدَرَّبَة نوعٌ خاص من الكلاب، وله مزايا عديدة تميزه عن سائر الكلاب. 2. أنَّ بيع الكلاب (البوليسية) المُدَرَّبَة يُحقق كثيراً من المصالح والمنافع، وثمة قواعد فقهية وأصولية تعضد القول بجواز "بيع الكلاب (البوليسية) المدرَّبة"؛ كقاعدة: الضرورات تبيح المحظورات، والاستحسان. الكلمات المفتاحية: بيع، شراء، الكلاب، البوليسية، المُدرَّبة، فقه، أصول، ضرورة. Abstract: This research reveals an emerging doctrinal issue: the sale of trained bloodhound and the development of the diversity of their use; for example: security, guarding, chasing criminals, identification of suspects, detection of drugs, explosives, robberies, saving lives, etc., which many states encourage to purchase, and use in order to establish and maintain security, and to utilize in many areas, there is a need to reconsider the context of the issue, examining and discussing their legal evidence, both essential and ancillary evidence, as well as their doctrinal fundamental rules, and discussing them in order to obtain the appropriate legal judgement. This research followed the inductive and analytical approach and reached several conclusions, including: 1. Trained bloodhounds are a special type of dogs, and they have many advantages that distinguish them from other dogs. 2. The sale of trained bloodhounds achieves many interests and benefits, and there are doctrinal and fundamental rules that support the statement that it is permissible to sell trained bloodhounds such as: Necessities permit prohibition, and Al- Istihsan.
