الملخص
فهذا البحث يعالج مسألة هامة من مسائل أصول الفقه وهي اقتضاء النهي الفساد، حيث إنّ هذه المسألة من مهمّات الفوائد وأمّهات القواعد التي كتب فيها العلماء قديما وحديثا؛ لرجوع كثير من المسائل الفرعية إليها، فإنّ النهي من المباحث اللّفظيّة التي تتّصل باستخراج الأحكام من أدلّتها الشّرعيّة، وهو من الألفاظ التي يراد منها الكفّ عن المنهيّ عنه وتركه، طلبا لرضا الله ونيل ثوابه، وقد تناول الباحث في المبحث الأول معنى النّهي وأقسامه وصيغته، وتحدّث في المبحث الثاني عن موجب النهي ومقتضاه، أمّا المبحث الثالث وهو أهمّها فقد تناول فيه دلالة النّهي المطلق على فساد الأحكام وبطلانها، وذكر في المبحث الرابع بعض الأمثلة التطبيقية على اختلاف الفقهاء في دلالة النهي وأثر هذا الاختلاف على آرائهم الفقهيّة في كثير من الاحكام. وتوّصل الباحث من خلال هذا العمل إلى نتائج وفوائد لخّصها في نهاية بحثه، أهمّها أنّ النّهي المطلق يدلّ على فساد الأحكام وبطلانها شرعاً وهو مذهب أكثر العلماء. This research addresses an important matter of the issues of jurisprudence fundamentals, which requires the prohibition of corruption, as this issue is of the tasks of the benefits and the origins of the rules in which the scientists wrote in the past and present; since many of the subsidiary issues refer to it, the prohibition is of the verbal studies witch are related to extraction of judgments from their legitimate evident, and it is of the vocalizations that are meant to stop what is forbidden and leave it, just for God's satisfaction and reward. The researcher discussed. in the first research, the meaning of the prohibition and its divisions and formula, and in the second one, he talked about the purpose of prohibition and its requirement, while in the third study which is the most important, he has dealt with the indication of the absolute prohibition on the corruption and void of the judgments, He presented some empirical examples in the fourth part. The researcher concluded through this work to results and benefits that he summed up the end of his research, the most important of which is that absolute prohibition indicates to the corruption and void of the judgments legally, and this is the doctrine of most scholars.
