صلاحيات النائب الشرعي على تصرفات الغير في نظام النيابة الشرعية Powers Of The Legal Representative Over The Actions Of Others In The Legal Prosecution System

Abstract
The rights of the minor have received unparalleled attention and care, starting from the heavenly laws to the organic legislation represented in the legal prosecution system with its three areas of guardianship, guardianship and submission. The legislator who enacts laws and the judge who interprets and separates them according to each case separately As the legislator identifies people who fulfill the legal conditions to act on behalf of the minor in establishing some actions, as for the insane and the insane with no capacity, and the fool lacks capacity, the legislator has equalized them, just as the legislator restricted some of the powers granted to the legitimate representative, which are of a financial nature over the money of those who are In his ruling and making it subject to the permission of the judge, while making the actions of the legal representative purely beneficial or related to the work of administration, usufruct, or preservation and maintenance, which usually do not affect the financial responsibility of the person under the legal representation, he made them free and not subject to permission from the judiciary. إن حقوق القاصر قد حضيت بإهتمام ورعاية المثيل لها بدءا من الشرائع السماوية إلى التشريعات العضوية المتمثلة في نظام النيابة الشرعية بمجاالته الثالث الوالية والوصاية والتقديم فقد جاءت ألجل حماية حقوق القصر وناقصي ومعدومي األهلية وكذلك الحماية القضائية لهاته الفئات ولتجسيد هذه الحماية ركز قانون األسرة الجزائري على التعاون بين المشرع الذي يسن القوانين وبين القاضي الذي يفسرها ويفصلها حسب كل حالة على حدى حيث أن تحديد المشرع ألشخاص يتوفر فيهم الشروط القانونية لينوبوا عن القاصر في إنشاء بعض التصرفات، أما بالنسبة للمجنون والمعتوه عديمي األهلية وإن السفيه ناقص األهلية فالمشرع قد ساوى بينهم، كما أن المشرع قيد بعض سلطات الممنوحة للنائب شرعي والتي تكون ذات طبيعة مالية على أموال من هم في حكمه وجعلها تخضع إلذن القاضي في حين جعل تصرفات النائب الشرعي النافعة نفعا محضا أو ذات صلة باعمال اإلدارة و اإلنتفاع أو الحفظ والصيانة والتي التمس عادة بالذمة المالية للشخص تحت النيابة الشرعية جعلها حرة وغير خاضعة إلذن من طرف القضاء
