تدارك تقدير التعويض عن الضرر المتغير في المسؤولية التقصيرية

الملخص
تعد القضايا المتعلقة بالتعويض من أبرز ما يطرح في ساحة القضاء، خاصة بعد التطور والتعقيد الذي طال صور المسؤولية والذي كان له التأثير الواضح على القواعد القانونية التي تحكمها ومن بينها مسألة تقدير التعويض. وقد لا يجد القاضي صعوبة في تقديره للتعويض إذا كان الضرر ثابتا، ولكن في حالة عدم استقراره وتغيره سواء بالزيادة أو النقصان فإن تقدير القاضي هنا لا بد أن يراعي الظروف الملابسة، كما أن مسألة تقدير التعويض قد تكون مؤقتة خاصة إذا احتفظ القاضي للمتضرر بحقه في تداركه، وهو ما يدعو إلى التعرف على قواعد تقدير هذا النوع من الضرر إضافة إلى بيان الوقت المحدد لتداركه، كل ذلك مع مراعاة حق المضرور وإقامة التوازن والعدالة بين طرفي دعوى التعويض. The related issues to compensation is one of the most prominent issues presented in the judicial arena, especially after development and complexity which affected the images of responsibility and which had a clear impact on the legal rules that govern it among them is the issue of estimating compensation. The judge may not find difficulty in his assessment of compensation if the damage is constant, but if it is unstable and changes either increase or decrease the judge s discretion must take into account the circumstances, also, the issue of estimating compensation may be temporary especially if the judge reserves the right for the injured party to remedy it, this calls for familiarization with the rules of this type of damage includes an indication of the specific time to remedy it, all this while taking into account the rights of the injured party and establishing balance and justice between the two parties to the compensation claim.
