حالات الخلو المؤقت لمنصب رئيس الدولة في التشريع الفلسطيني

الملخص
تناولت هذه الدراسة موضوع حالات الخلو المؤقت لمنصب رئيس الدولة في التشريع الفلسطيني، وقد تم معالجته على صعيد الأنظمة الدستورية وذلك باستخدام المنهج التحليلي، بالإضافة إلى المنهج المقارن. وطرحت الدراسة اشكاليتها الرئيسية، والتي تمحورت حول مدى كفاية التنظيم القانوني لحالات الخلو المؤقت لمنصب رئيس الدولة في التشريع الفلسطيني والتشريعات المقارنة محل الدراسة؟ وتمت الإجابة عن هذا التساؤل من خلال تقسيم الدراسة إلى مبحث واحد يضم مطلبين، ولقد توصل الباحث من خلال ذلك إلى مجموعة من النتائج واقترح العديد من التوصيات، ومن أهم هذه النتائج هي أن المشرع الفلسطيني لم يتناول البتة حالات الخلو المؤقت لمنصب رئيس الدولة، واقترح العديد من التوصيات كأن أهمها كان لزاماً على المشرع الفلسطيني وضع تأطير دستوري ورسم تقنية دستورية من خلال اقتراح نصوص تشريعية تنظم عملية الخلو المؤقت لمنصب رئاسة الدولة. This study discusses the issue of temporary vacancies for the position of the head of state in Palestinian legislation, and it was addressed at the level of constitutional systems, using the analytical approach, in addition to the comparative approach. The study presented its main problem, which focused around the statement of the extent of the constitutional precaution regarding the legal regulation of cases of temporary vacancy for the position of the head of state in the Palestinian legislation and the comparative legislation under study? results and suggested many recommendations This question was answered by dividing the study into one section that includes two requirements, and the researcher reached a set of . The most important of these is setting a constitutional framework and drawing up a constitutional technique by proposing legislative texts regulating the process of temporary vacancy for the position of the Presidency of the State.
