الملخص

يعتبر العرف مصدراً هاماً من مصادر القانون الدستوري إلى جانب كل من التشريع والقضاء والفقه، فهو ذات أهمية وطبيعة خاصة من ناحية تاريخية وسياسية، كونه يعبر عن إرادة الهيئة الحاكمة التي تمثل إرادة أفراد المجتمع السياسي عند انتهاجها سلوك معين بشرط تكرارها له وشعورها بإلزاميته، كما أنه قد يتنوع العرف الدستوري فقد يكون مفسراً لقاعدة دستورية وقد يكون مكملاً أو معدلاً أم بالإضافة أو الحذف وقد يكون مناقضاً، وقد شكل العرف الدستوري أهمية ليست بالبسيطة في الحالة الفلسطينية كون أن هناك العديد من المسائل الدستورية تم تنظيمها بواسطة العرف الدستوري. Custom is an important source of constitutional law in addition to legislation, the judiciary, and jurisprudence. It is of special importance and nature from a historical and political point of view, as it expresses the will of the ruling body that represents members of the political community when it adopts a certain behavior provided that it repeats it and feels its obligation, and the custom may vary. The constitutional norm may be an explanation of a constitutional rule and it may be complementary, amending, adding or omitting, or it may be contradictory.The constitutional custom has been of no small importance in the Palestinian case, since there are many constitutional issues that have been regulated by the constitutional custom.
