المسؤولية الدولية والجنائية المترتبة عن انتهاك مبدأ حماية الممتلكات والتراث المخطوط : دراسة تحليلية في ضوء نصوص بعض الاتفاقيات الدولية

الملخص
يهدف البحث إلى توضيح حالة هذه الممتلكات والتراث المخطوط بشكل خاص نظرا لتعرضه للعديد من المخاطر والتهديدات ومدى الاهتمام الدولي بها والحفاظ على التراث المخطط له من الانتهاكات المختلفة، وذلك بقراءة وتحليل نصوص ومواد بعض الاتفاقيات الدولية ، ولا سيما إتفاقية لاهاي لعام 1954 والبروتوكولين الملحقين بها معتمدا على المنهج الوصفي، وتحديد أهم القواعد التي وضعت من أجل توفير وضمان قدر أكبر من الحماية له وهذا نتيجة لضعف الإشراف على تنفيذ أحكام الاتفاقيات، وأيضا عدم وجود تنسيق فعال بين المنظمات الدولية The research aims at clarifying the status of thèse properties and the planned heritage in particular, given that they are exposed to many risks and threats and the extent of international attention to them, and preserving the planned heritage of different violations by reading and analyzing the texts and articles of some international conventions, especially the Hague Convention of 1954 and the two protocols thereto Based on the descriptive method, and identifying the most important rules that have been established in order to provide and ensure greater protection for them. This is a result of the weak supervision of the implementation of the provisions of the conventions, as well as the lack of effective coordination between international organizations
