المستحدث في السياسة الوقائية للحد من جرائم المخدرات والمؤثرات العقلية في الجزائر The New Policy In Preventively Addressing Drugs And Psychotropic Substances-related Offences In Algeria

الملخص
يهدف هذا البحث إلى دراسة التعديلات الجوهرية التي أدخلها المشرع الجزائري بموجب القانون 23-05 مؤرخ في 7 ماي 2023 يتعلق بالوقاية من المخدرات والمؤثرات العقلية ومكافحتهما، المتعلقة بالسياسة الوقائية الجديدة للحد من جرائم المخدرات والتي أعاد من خلالها صياغة إستراتيجية وطنية شاملة ترتكز أساسا على تعزيز الوعي لدى الجميع بخطورة وأضرار المخدرات والمؤثرات العقلية وإعطاء الأولوية في مكافحة هذه الجرائم للسياسة الوقائية والعلاجية قبل المقاربة الأمنية والقضائية. ولقد توصلنا في نهاية هذا البحث إلى أن مخرجات السياسة الوقائية المعلن عنها بموجب القانون 23-05 تتميز بالقوة في الحد من جرائم المخدرات والمؤثرات العقلية، وسينعكس ذلك على أرض الواقع إذا ما تم تطبيقها وتفعيلها وفقا لما نص عليه هذا القانون The aim of this study is to explore the fundamental amendments made by the Algerian legislature under Law 23-05 dated May 7, 2023, pertaining to the prevention and suppression of drugs and psychotropic substances. These amendments concern the new preventive policy designed to reduce drug offences, which has reformulated a comprehensive national strategy that is primarily based on raising awareness about the risks and detrimental impact of drugs and psychotropic substances. The approach towards combating these offences involves giving priority to prevention and treatment policies rather than relying solely on security and judiciary approaches. After conducting this study, it has been found that the preventive policy announced in compliance with the Law 23-05 is effective in reducing drug and psychotropic substances offences, and this will be reflected in application if it is implemented and activated as stipulated by the law
