صعوبات إثبات الخطأ الطبي المرفقي وكيفيات تذليلها

الملخص
إن إثبات قيام المسؤولية الطبية المرفقية يقتضي إثبات خطا الطبيب او خطا الإدارة الصحية تجاه المريض إضافة الى الضرر الواقع وعلاقة السببية بينهما، وهو امر صعب للغاية إن لم يكن مستحيل، خاصة وان المكلف بعبء الإثبات هو مريض يجهل اصول مهنة الطب وفنها وتقنيتها، فضلا عن حالته ومعاناته اثناء حدوث الخطأ، ولما كانت غاية الفقه والقضاء هي تعويض المريض المضرور بأية وسيلة وإدراكا للصعوبات التي يواجهها المريض في سبيل النهوض بهذا العبء اوجدت بعض الحلول لنقل عبء الإثبات تارة وللتحقق منه تارة اخرى. Proving the existence of attachment medical liability requires proving the fault of the doctor or the fault of the health administration towards the patient in addition to the damage and the causal relationship between them, which is very difficult if not impossible, especially since the person charged with the burden of proof is a patient who is ignorant of the origins, art and technology of the medical profession, as well as his condition and suffering during the occurrence of the error. Since the purpose of jurisprudence and jurisprudence is to compensate the injured patient by any means and aware of the difficulties faced by the patient in order to carry out this burden, some solutions have been found to transfer the burden of proof at times and to verify it at other times.
