ملخص: استبدل تعديل سنة 2020 للدستور المجلس الدستوري بالمحكمة الدستورية، والتي باشرت وظيفتها في رقابة الدستورية بعد تشكيلها مباشرة، ومن النصوص المراقبة القانون العضوي للإعلام، وباعتباره قانونا عضويا فقد طابقته للدستور وجوبا ولمرتين قبل إصداره، نتيجة لخطا في الاخطار به، مما يسمح بالوقوف على منهجية اجتهادها في تأمين مطابقته، ومطابقة القوانين العضوية بصفة عامة. وفي هذا الخصوص، أصدرت اجتهادين اثنين، أمنّت فيهما المطابقة الدستورية بمنهجية تتناول أولا المطابقة الشكلية الخارجية، ثم المطابقة الموضوعية الداخلية لمواد النص. Abstract: The 2020 amendment to the Constitution replaced the Constitutional Council by the Constitutional Court, as a Constitutional Justice Organ to ensure the constitutionality of laws, and one of these is the Organic Media Law, as a result of an error in notification, it conformed twice before its issuance, which allows to study the rules of the constitutional jurisprudence in ensuring the conformity of this law and the organic laws in general. In this regard, the Court issued two decisions, in which it clarified its rules and methodology for the constitutional conformity, it starts first by conformity the form, and then conformity the substance of the articles of the text.
