الملخص
الملخص: كرّس المشرع الجزائري الحق في البيئة دستوريا بموجب المادة 68 من التعديل الدستوري لسنة 2016، وما لبث أن عدّل هذا النص بواسطة المادة 64 من التعديل الدستوري لسنة 2020، التي تضمّنت بعض المصطلحات التي توحي بأن المشرع قد تراجع عن الحماية الدستورية التي سبق له إقرارها، لذلك فإن هذه الدراسة تهدف إلى التحقُّق مما إذا كان التعديل الدستوري الأخير يشكّل فعلا تراجعا عن الحماية الدستورية التي أقرها تعديل 2016. وقد تم التوصل إلى أن ربط المادة 64 لحق المواطن في بيئة سليمة بالتنمية المستدامة بعدما كان حقا عاما وشاملا، يشكّلُ في الحقيقة تقيّيدا للتمتع بهذا الحق بإطار معيّن، يصعب تحديده لصعوبة تحديد مفهوم التنمية المستدامة في حد ذاته، مما يُتيح للدولة التحكّم فيه ضيقا واتساعا بما يخدم مصالحها، كما يُشكّل إعفاء الدولة من الالتزام بالعمل على الحفاظ على البيئة تجريدا للمواطن من بعض أوجه الحماية الدستورية التي كانت مقررة لحقه في البيئة. Abstract: The Algerian legislator introduced the constitutional right to environment by virtue of Article 68 of the 2016 constitutional amendment. However, the above-mentioned text was soon amended by Article 64 of the 2020 constitutional amendment, which includes certain terms that imply that the legislator waived the constitutional protection which had already been approved previously.. The study has revealed that the fact that article 64 links the citizen’s right to a sane environment with durable development, after it had been approved as a general and universal right, actually limits the citizen’s right to environment to a certain frame that is difficult to define since the concept of durable development is, itself, difficult to define; this would allow the State to control this right following its interests.
