النظر في منهج البحث الفقهي المقارن بالقانون Examining The Methodology Of Comparative Jurisprudential Research With Law

الملخص

يسعى ذا البحث لبيان بعض النقائص المنهجية في الدراسات التشريعية المقارنة لطلبة الدراسات العليا، من خلال الإجابة على التساؤلات التالية: ما واقع البحث الفقهي المقارن؟ وما هي نقائصه المنهجية؟ وتمثلت الإجابة عن ذلك من خلال المحاور التالية: واقع البحث الفقهي المقارن، نقائص البحث الفقهي المقارن بالقانون، وأخيرا كيفية تلافي هذه النقائص. This research aims to identify some methodological shortcomings in comparative legislative studies for graduate students by answering the following questions: What is the reality of comparative jurisprudential research? What are its methodological shortcomings? The answers are presented through the following axes: the reality of comparative jurisprudential research, methodological shortcomings of comparative jurisprudential research with law, and finally, how to address these shortcomings.
