الظوابط العلمية لدراسة وتجديد الفقه الإسلامي

الملخص
جاء هذا البحث لبيان أهم الضوابط العلمية لدراسة علم أصول الفقه، فذكر ضوابط دراسته والأخذ بمنهج التيسير مع مراعاة النظر في معنى الاجتهاد والتقليد، ثم انتقل إلى الحديث عن معنى التجديد ومشروعيته، وكون أن صبغة التدريس التلقيني -التي تكاد تكون الصفة الغالبة على أسلوب التدريس على مستوى الدراسات العليا- لا تسمح بالإبداع والتجديد، أكّد الباحث على ضرورة إعادة النظر في الأساليب التدريسية المطبقة في تدريس الفقه الإسلامي وأصوله والاستفادة من الأساليب الحديثة حيث اقترح استخدام استراتيجية الخرائط المفاهيمية التي أوصى بها كل من مؤتمر تدريس الفقه الإسلامي ومؤتمر علوم الشريعة في الجامعات، فبيّن أهميّتها، وخطوات بنائها. ومن النتائج المتوصل إليها أنّ المنهج الفقهي مازال بحاجة إلى مزيد دراسة تضبط المفهوم والمنهج. This study presents the main scientific controls for studying the principles of Islamic jurisprudence, discussing the controls of its study and using the methodology of simplification while taking into account the meanings of ijtihad (independent reasoning) and taqlid (imitation). It then moves on to explore the meaning and legitimacy of renewal, noting that the traditional lecture-based teaching approach in higher education does not allow for innovation or renewal. The researcher emphasized the need to review the teaching methods used in teaching Islamic jurisprudence and its principles and to utilize modern techniques. Moreover, the researcher suggested incorporating the use of conceptual maps, which have been endorsed by both the Conference on Islamic Jurisprudence Teaching and the Conference on Sharia Sciences in universities. Thus, illustrating their importance and the process of creating them. It has been concluded that the Islamic Jurisprudence approach still needs more research to clarify its concept and approach.
