الملخص

يعد الإقرار من أهم وسائل الإثبات؛ حيث إنه بمعنى الشهادة على النفس التي لا تعادلها شهادة في القوة، وعليه فإن هذه الدراسة تناولت ضابطا فقهيا من ضوابط الإقرار، وهو "الضابط الفقهي جهالة المقر به لا تمنع صحة الإقرار" بهدف إبراز مفهومه، ومعناه الإجمالي، وتأصيله، وتطبيقاته في الفروع الفقهية، وبعد التطرق له، وتنزيله في مطالبها توصلت الدراسة إلى أن المراد بجهالة المقر به؛ هو عدم اقتران الإقرار، ببيان جنس الحق المقر به، أو نوعه، أو مقداره، كما توصلت إلى أن هذا الضابط محل اتفاق بين الفقهاء، وقد عبروا عنه في صيغ متعددة بنفس المعنى، و إثر هذه النتائج أوصت الدراسة إلى إعطاء الضوابط الفقهية المزيد من الدراسة والاهتمام في البحوث والدراسات المعاصرة، مع عقد مؤتمرات وندوات علمية تلقي الضوء على أهمية الضوابط والقواعد الفقهية في فهم مسائل الفقه المختلفة؛ إذ إن عليها مدار العديد من المسائل والفروع الفقهية. Declaration is an essential means for evidence, as it indicates the testimony against oneself, which is not comparable, in its force, to any other testimony. Therefore, this study provides a jurisprudential rule for declaration namely “declarant’s unawareness shall not cease the validity of declaration” for demonstrating the concept of this rule as well as its extensive meaning, legality, and applications in jurisprudential disciplines. After this objective was indicated to demonstrate that the unawareness of the declarant is suggestive of the non-association of declaration with demonstrating the type, kind, or proportion of the established right. Furthermore, the study concluded that this rule has been agreed upon by the scholars who defined it in various expressions but under the same meaning. Such results recommended that jurisprudential rules must be given more study and attention, as it is the main pillar for many jurisprudential issues and concerns. Also, academic seminars should be held to shed light on the importance of jurisprudential rules for understanding various jurisprudential issues.
