أثر المعاهدات الدولية في فرض العولمة التشريعية على القانون الجزائري-المسائل الجنائية والأحوال الشخصية نموذجا -

الملخص
ملخص: لقد مدّت العولمة الغربية نفوذها على كافة جوانب الحياة الإنسانية الاجتماعية والثقافية والاقتصادية والسياسية، ولم يبق اليوم مجال من مجالات الحياة إلا وقد ظهرت فيه آثارها، التي شملت صعيد العلاقات الدولية فظهر النظام العالمي الجديد بمساعي الدول الكبرى تحت قيادة الولايات المتحدة الأمريكية، التي تمارس واقعيا دور الحكومة التي تتولى تسير وتنظيم العلاقات الدولية بين أعضاء المجتمع الدولي، ومن أجل الوصول إلى إحكام سيطرة أكثر على زمام السلطة في المجتمع الدولي، سعت الدول الكبرى للتأثير على القوانين الداخلية للدول، والعمل على تعديلها وصقلها بما يتناسب مع تطلعاتها لحكم العالم، ولم تجد منفذا لذلك أفضل من المعاهدات الدولية، لاسيما بعد تكريس مبدأ سمو المعاهدات الدولية على القانون الداخلي في معظم دساتير دول العالم، وفي هذا البحث، سوف نكشف عن كيفية اتخاذ الدول الكبرى للمعاهدات الدولية وسيلة لفرض ما يعرف بالعولمة التشريعية، وبيان أثر ذلك في القانون الجزائري. Abstract: Western globalization has cast its shadow over all aspects of human social, cultural, economic, and political life. Today, there is no field of life that has not been affected by the consequences of globalization. Even in the realm of international relations, a new global system has emerged, led by major powers, with the United States of America at the forefront. In practice, the United States acts as the government responsible for managing and organizing international relations among members of the international community. In order to achieve greater control over the reins of power in the international community, major powers have sought to access the domestic laws of countries and work on modifying and refining them to align with their aspirations for global governance. International treaties have been the most effective means to accomplish this, especially after the principle of the superiority of international treaties over domestic law has been enshrined in the constitutions of most countries around the world. In this research, we will uncover how major powers use international treaties as a means to impose what is known as legislative globalization and explain its impact on Algerian law.
