قراءةٌ تداولية في أفعال الأمر والنهي عند الأصوليين

الملخص
يهدف بحثنا إلى إعادة قراءة بحث علماء أصول الفقه في صيغ الأمر والنهي قراءةً تداوليةً، وهذا من خلال المفاهيم التي تقدّمها نظرية الأفعال الكلامية، وننطلق من أنّ الأمر والنهي صيغتان قوليّتان تدلاّن على الطلب ويمكن أن تنشأ عنهما أفعال إنجازية، ثمّ نحاول أن ندرس كيف صنّف الأصوليون أنواع الحكم الشرعي ضمن الأفعال الإنجازية مع دراسة أهمّ الشروط التي يمكن أن تحتويها تلك الأفعال الإنجازية. In this article we try to re-understand the research given by the scientists of the roots of the law, especially in the terms of imperative and prohibition with a new pragmatic lecture, And by the terms of the speech acts theory, We start by concept that the imperative and the prohibition are linguistic compositions means a request and can be consider as a performatif act, We try secondly to prove that the researches in the roots of the law comprise a classification of the performatif acts with some conditions in the legitimate discourse.
