الملخص

لقد جاءت هذه الدراسة من اجل البحث عن السبل الكفيلة والأكثر فعالية في تحقيق أهداف السياسة العقابية الحديثة المبنية على أساس العمل الوقائي في مكافحة ظاهرة الإجرام بشتى أنواعه في مواجهة الأساليب التقليدية الكلاسيكية المبنية على أساس الردع والعقاب والإكراه البدني الذي اثبت الوقع محدوديته بشكل كبيرة خاصة في مواجهة الجرائم الخطيرة في المكافحة، وهو الأمر الذي دأبت عليه اغلب دول العالم المتقدمة التي بدأت في الاستغناء تدريجيا على الأسلوب الردعي واستبداله بأساليب اجتماعية ونفسية وحتى اقتصادية . انطلاقا من هنا جاءت السياسة العقابية الحديثة من اجل محاولة التقليل من تطبيق العقوبات السالبة للحرية وانتهاج سياسة العقوبات البديلة التي تقوم على تنفيذ العقوبات داخل المجتمع وبين أفراده، مما يكون أصلح للمحكوم عليه و ينعكس إيجابا عليه وعلى عائلته بصفة خاصة وعلى المجتمع بصفة عامة، وأن قطاع السجون يكلف خزينة الدولة تكاليف باهظة تخصص لتغطية النفقات المختلفة المادية والبشرية التي يحتاجها القطاع خاصة في تطبيق الأنظمة العقابية الحديثة التي تتطلب عناية خاصة و مستمرة من أجل تطبيق برامج تأهيل وإعادة إدماج المحبوسين. Abstract: This study came in order to search for the most effective and effective ways to achieve the objectives of the modern penal policy based on preventive work in combating the phenomenon of crime of all kinds in the face of the classic traditional methods built on the basis of deterrence, punishment and physical coercion, the impact of which has proven to be very limited, especially in the face of Serious crimes are to be combated, which is what most developed countries of the world have been doing, which have begun to gradually dispense with the deterrent method and replace it with social, psychological, and even economic methods. From here, the modern penal policy came in order to try to reduce the application of custodial punishments and to adopt an alternative punishment policy that is based on implementing punishments within society and among its members, which is better for the convict and reflects positively on him and his family in particular and on society in general, and that the sector Prisons cost the state treasury huge costs, which are allocated to cover the various material and human expenses that the sector needs, especially in implementing modern penal systems that require special and continuous attention in order to implement rehabilitation and reintegration programs for detainees.
