النظام العام المستحدث والأطراف الفاعلة في بلورته

الملخص
لقد تم توسيع دائرة الثلاثية التقليدية للنظام العام لتشمل عناصر أخرى استحدثت تبعا لتطور تصورات المجتمع وتطلعاته من جهة، وزيادة مجال تدخل الدولة في مختلف المسائل الاجتماعية والاقتصادية وغيرها من جهة ثانية، وتؤدي كل من السلطات الثلاث دورها ضمن مسار تطوير عناصر النظام العام، وللقضاء دور بارز في تقرير الوجود المستقل لعناصر مستحدثة، تمثلت في النظام العام الأدبي، والنظام العام الاجتماعي و الاقتصادي، إضافة إلى النظام العام الجمالي، ويظهر من خلال ما خلصت إليه هذه الورقة البحثية أن القائمة مفتوحة لظهور عناصر أخرى تحاكي تطور المجتمع ونظرة الدولة لمختلف مناحي الحياة ومدى إمكانية التدخل فيها وفقا لظروف الزمان والمكان. Le cercle de la trilogie traditionnelle de l’ordre public a été élargi pour inclure d’autres éléments introduits en fonction de l’évolution des perceptions et des aspirations de la société d’une part, et augmentant de la portée de l’intervention de l’état dans diverses questions sociales, économiques, et d’autres sphères, en second part, chacune des trois autorités joue son rôle dans la voie du développement des éléments de l’ordre public, et le pouvoir judiciaire a un rôle de premier plan dans la détermination de l’existence indépendante de nouveaux éléments, représentés par l’ordre public moral, l’ordre public social et économique, et l’ordre public esthétique, il montre à travers la conclusion de ce document que la liste et ouverte à l’émergence d’autres éléments qui imitent l’évolution de la société et la vision de l’état sur les différents aspects de la vie et la mesure dans laquelle ils peuvent être interférés en fonction des circonstances du temps et de l’espace. The circle of traditional triad of public order has been expanded to include other elements introduced acording to the evolution of society’s perceptions and aspirations on the one hand, and increasing the scope of the state’s intervention in various social, economic and other matters on the other hand, and each of the three authorities plays its role whithin the path of developing elements of public order, and the judiciary has a prominent role to play in determining the independent existence of new elements, it consists publicmoralorder, social and economic order, as well as aesthetic public order, according to this research paper, the list is open to the emergence of other elements that reflect the evolution of society, the state’s view of defferent aspects of life and the extent to which they can be interfered with an accordance with the circumstance of time and space.
