الترشح للرئاسيات (حالة الجزائر)

الملخص
تشكل الانتخابات في جميع النظم الديمقراطية وسيلة لاختيار الحكام او ممثلي الشعب في المجالس المنتخبة الوطنية والمحلية. تعتبر عملية انتخاب رئيس الجمهورية ,تكريس لمبدأ التداول على السلطة و اشراك المواطن في الاختيار الحر للمترشح الانسب و الافضل, تعتبر ملامح شخصية المترشح عاملا حاسما يتوقف عليه اختيار المواطن ,لبلوغ هذا الهدف أرست الدساتير مبادئ حرية الترشح وعدم التمييز بين المتنافسين و المساواة بين المواطنين في الانتخاب و الترشح ونصت القوانين (العضوية)على قواعد من المفترض أنها ترسخ هذه المبادئ الا أنه يتضح من دراسة هذه القواعد و الشروط الموضوعية و الشكلية التي وردت فيها رتبت قيودا تحول دون تجسيد المبادئ الدستورية ،لذا فإن التفكير في مسألة السن ومساره السياسي و الإداري و ثقافته و إطلاعه على القضايا الدولية و الداخلية يجب أخذها بعين الإعتبار في شخصية المترشح في القوانين . Elections in all democratic systems constitute a means for choosing rulers or people’s representatives in the national and local elected councils. The process of electing the president of the republic is a consecration of the principle of devolution of power and the citizen’s participation in the free choice of the most appropriate and best candidate. The citizen, to achieve this goal, the constitutions laid down the principles of freedom of candidacy, non-discrimination between competitors and equality between citizens in the election and candidacy. The laws (organic) stipulated rules that are supposed to establish these principles, but it is clear from the study of these rules and the objective and formal conditions in which they are mentioned. Arranged restrictions that prevent the embodiment of constitutional principles, therofore , thinking about the issue of age , its political and administrative trajectory ,its culture , and its knowledge of international and domestic issues, must be taken into consideration in the candidate’s personality in the laws.
