أثر إجراء الشهر العيني على عقد هبة العقار طبقا للتشريع الجزائري

الملخص
يخضع عقد هبة العقار لإجراء الشهر العيني لإتمام نقل ملكية العقار الموهوب المستوفي لإجراء المسح العقاري إلى الموهوب إليه، ويرتب الشهر العيني أثره الناقل ليس فقط في مواجهة إرادة طرفي العقد المتجسدة من خلال العقد التوثيقي بل حتى في مواجهة الغير، غير أن المشرع الجزائري استثنى من مبدأ الأثر الناقل للشهر العيني حالة العقد التوثيقي المشهر بعد الوفاة، فتنتقل ملكية العقار الموهوب بموجب العقد التوثيقي في حال وفاة الواهب قبل شهر العقد ابتداء من تاريخ الوفاة ، ولا يعتبر تصرف الواهب المتوفى قبل شهر العقد تصرفا مضافا لما بعد الموت، في حين فتح المشرع الجزائري المجال للطعن في صحة عقد هبة العقار المشهر نظرا لعدم أخذه بالأثر المطهر للشهر العيني. Abstract :The gift contract of real estate, is subject to the in-kind real estate registration, to complete the transfer of real estate property gifted, that fulfils the real estate survey procedure, to the gifted, and the in-kind real estate registration has the effect of the carrier, not only in the face of the will of the parties to the contract, but even in the face of others. The Algerian legislator, has exempted from the principle of the conveyor effect, a status of notarial contract publicized after death, so the gifted property is transferred according to the notarial contract in the event of the death of the donor, and donor's act before the real estate registration of the contract, is not considered to be an additional conduct after death, while the Algerian legislator, opened the way to challenge the validity of the real estate gift contract publicized , because it not take into account, the purgatory effect of the real estate registration
