حكم إدراج شرط سقوط الحق في الضمان في عقد التأمين

الملخص
ملخص باللغة العربية: تهدف هذه الدراسة إلى ضبط مفهوم شرط سقوط حق المؤمن له في الضمان، وكذا تحديد طبيعة هذا الشرط، الذي يعتبر التزام اتفاقي من جهة، تطبيقا لمبدأ العقد شريعة المتعاقدين، ويشكل من جهة أخرى شرط تعسفي في حالة تعسف المؤمن في استعمال حقه، الأمر الذي يستدعي حماية المؤمن له من هذا الشرط. Abstract: This study aims at controlling the concept of of the condition of the fall of the right to warranty in the insurance contract, which is an agreement on the one hand, according to the principle of contract is the law of contractors, on the other hand, it is sometimes an arbitrary condition, which necessitates the protection of the insured against this condition in the case of the arbitrariness of the insurer.
