فقه الأولويات وعلاقته بالأمر والنهي The Jurisprudence Of Priorities And Its Relationship With Order And Forbidding

الملخص

تتناول هذه الورقة البحثية موضوع فقه الأولويات وعلاقته بالأمر والنهي في الشّريعة، وتكشف عن بعض المعالم التي يتبين بها سلم ترتيب الأعمال، مع بيان لبعض حكم الشّريعة في هذا الترتيب، وأسرارها في نظام التّمييز. وتكمن مشكلة البحث في الفحص عن معيار الشريعة الذي بنيت عليه رتب الأعمال هذا المعيار الذي يضمن حفظ معالم الشّريعة من التّغيير، ويضمن أيضا عدم اختلال نسب الأحكام ومراتبها. وخلص البحث إلى ضرورة مراعاة ترتيب الشريعة في الأمر والنهي، لأن هذا الترتيب يخضع لمعيار المصلحة والمفسدة التي هي مقصود الشريعة من الأمر والنهي، كما أبرز هذا البحث عناية العلماء بهذا الفقه الأصيل ألا وهو فقه مراتب الأعمال، وجهودهم في تأسيس قواعده وتثبيت أركانه. Abstract: This research paper deals with the topic of jurisprudence of priorities and its relationship with order and forbidding in the Sharia (Islamic law), and reveals some features by which the works order scale is defined, with an identification of some underlying reasons of Sharia in this order, and the secrets of the distinction system. The problem of the research is in the examination of the Sharia standard, on which the grades of the works are based; this standard that ensures the preservation of the features of Sharia from change, and ensures also the non-disturbance of the amounts of rules and their grades. The research concluded the necessity of considering the order of Sharia in order and forbidding, because this order is subject to the standards of interest and evil which are the reason of Sharia behind order and forbidding. This research revealed also the attention paid by the scientists to this authentic jurisprudence which is the understanding of works grades, and their efforts in establishing its bases and consolidating its pillars.
